How to prepare for your family law mediation

Mediations are an important tool used by separating families both before and during Court proceedings to attempt to resolve the dispute amicably. There are several different styles of mediation and it is important to find one the suits you. Mediation can be done with or without solicitors.
To prepare for your mediation you should discuss with your solicitor what your entitlements are and what you are prepared to propose at the mediation.
Know your numbers - have a copy of your balance sheet and know what assets you will be keeping, what your spouse will keep and what items need to be negotiated.
What are the practicalities of the children’s routine? An afternoon with one parent may work if they are the soccer coach but not on an afternoon of dancing where parents aren’t allowed to attend.
Be prepared to move. For a mediation to be successful both parties will need to make compromises.
Listen to what is really important to the other party. Communication, security and trust are the most common themes.
Set aside the entire day, while most family law mediations take only half a day, there may be paperwork to finalise which can take longer.
Have a plan for after the mediation no matter the outcome. Who is collecting the kids? Can you go for a walk or have a quiet cup of tea? Think about organising something easy for dinner and have a relaxed night.
Mediations are usually long and emotionally charged days. You need a solicitor that has listened to you in the lead up to your mediation and understands you, your family and what outcome you are seeking prior to the mediation.
